The SDI Review Process

There are four possible outcomes from the SDI Review process: Approval or denial, remand to obtain additional information, recommendation for waiver, or remand. Regardless of whether the review is conducted in-house or by an external consulting firm, the process is designed to empower businesses to realize cost savings. After receiving the SSDI Review, the SSA will decide whether to approve, defer, or remand. It then sends a memorandum to the MDH Unit informing it whether the data-related arrangement is approved, denied, deferred, and remanded. If the agreement is approved, the MDH unit may proceed with execution.

If an application is denied, the SSA will send a second notice. The applicant who was denied has sixty-five business days from the date to request a hearing in front of an Administrative Law Judge (ALJ). This hearing is the same as those on disability issues. It can be held in person, over the phone, or via videoconference. The applicant, or their representative, can bring witnesses to testify regarding the issues and the circumstances that led to the denial. An ALJ can also arrange for expert testimony in support of the case. The ALJ may notify the applicant by writing if they lose. The hearing could take many months.

The process of a disability review can take anywhere from three to seven years. It may be approved, denied, or remanded for additional information. The SSA may also begin a disability review if the individual has improved medically and could return to work.

Data-related agreement submitted to SDI Team through Cognito Forms

A Data-Related Agreement (DRA) is a legal document which requires the approval of the SDI Team before execution. These agreements must go through Cognito forms and include all relevant documentation and the proposed contracts. The SDI Team will have 30 days to review the Data-Related Agreement. They can also ask for additional information, such a SOC 2 Type II or security controls. They can also ask for additional questions, such as data migration questions.

Once a Data-Related Agreement (DRA) is submitted, the SDI Team reviews the documents and will recommend contracts. The Agreement is subject to the same privacy and security policies as other forms of documentation submitted through Cognito Forms.

The SDI Review Process
